The technicality with DQ: ice "cream" has to have a certain percentage of CREAM.has to have so much or not be called"cream". the soft serve would not be soft if it had that much cream. To retain the consistancy, has less cream. That is ALL. IT IS STILL DAIRY, JUST MORE LIKE ICED MILK.
