RIP Nubia. She and her twin brother Victor were placed in foster care with a couple who abused them and killed her. Despite multiple warning signs and calls to the child abuse hotline, there was no investigation. The couple, Jorge and Carmen Barahona, regularly beat them, bound them with tape and would leave them in the bathroom for days. Two years before her death the state awarded the Barahona's full permanent custody of Nubia and Victor. Authorities reported the abuse continued in the home. Beatings, hitting, punching, and bindings including being hogtied. Ice water poured on them, mouths taped, hit with a mop, punched in the mouth, choked, forced to eat a cockroach, eyes crazy glued shut. At school, Nubia was described as having a strong odor of old urine, uncontrollable hunger, stealing money for ice cream, jittery, her hair falling out. The teacher reported a detailed record and history on Nubia, yet the case was dismissed and no services were put in place. A month before her death, the police reported the twins continued to be beaten, tortured, and bound with clear tape, battered all over their bodies and left for days in the home's bathroom. Carmen reported they punished the twins by leaving them in the trash and recycle bins outside. On the day Nubia died, February 11, 2011, Jorge had taken her from the bathroom to the bedroom where he beat her until her screams stopped. Victor was still in the bathtub. Carmen gave Jorge money in order to get away. His work truck was found on the side of I-95 by highway patrol. Jorge was passed out, Victor was in the front seat, wounded by chemical burns. Nubia's remains were found partially decomposed in a trash bag filled with various chemicals. In 2020, Carmen Barahona pleaded guilty to 1st degree murder and accepted the sentence of life imprisonment in exchange for testifying against her husband. The state prosecutor was seeking the death penalty for both Carmen and Jorge, which she was able to avoid. After several changes of public defenders and years of delay, Jorge is expected to go to trial on March 15th, 2027. This tactic has cost the state of Florida over $2.6 million in legal fees in preparation for Jorge's defense. Let's be reminded that 17 children in Florida have been murdered by their placement providers. Among them is 7yo Samaya Gordon, who was abused and murdered by her foster provider in Miami-Dade as well as 13yo Selena Kellum who was murdered by a former DCF employee in Sebring, Florida. Numerous reports have been made against the state child welfare system. It has one of the worst reputations in the country for being the most corrupt. Children are being killed in the system by the very people paid to protect and keep them safe. This is not a sign of failure of a broken system, it is a clear pattern of disposing children for money. Treating these cases in isolation and prosecuting the killers is the state's way to avoid further accountability. Florida needs to be investigated, especially when numerous reports were made to CPS that could have prevented Nubia's death. The reality is we need to protect our children from the state. This is a national crisis.
