The judge who dismissed my lawsuit against the court-appointed doctor did not just rule against me, he rewrote my allegations. At the demurrer stage, the law requires judges to accept the pleaded facts as true. In other words, at this stage he is trier of law, not fact. He’s supposed to accept my claims as truth, to see if I’ve substantiated cognizable causes of action. I did, which is why he rewrote my claims. If I’m telling the truth is tried by the trier of fact, which is the jury. This is critical, because it’s where courts are tricking self represented litigants. Instead, the judge flipped the demurrer standard upside down, misrepresented my claims, and granted Dr. Jakubowski quasi-judicial immunity by relying on facts my complaint expressly disputes. The judge had to do this, because if my allegations were accepted as true, as the law commands the court, then he could not give the court doctor immunity, because she did not function as an adjudicator, but involved in extrinsic fraud, malicious prosecution, a conspiracy. The Third District doubled down during oral argument. Rather than confining itself to the pleadings, it relied on factual predicates outside my complaint, exactly what the law forbids at this stage. This is not an error, it’s is a structural and blatant violation of due process. Now the matter sits before the California Supreme Court. But here’s what makes this extraordinary…the Chief Justice appointed the very judge who dismissed my case, and now the institution must decide whether it will confront or conceal what happened. But I will expose the Supreme Court and show you exactly how they are about to attempt to cheat me, so that you can be better prepared to protect yourself, and recognize the truth about our state judiciary; and I’ll show you how I will pursue my case in the Eastern District Federal Court and U.S. Supreme Court.
