What’s worse… This implies that businesses and states that paid these tariffs may be entitled to REFUNDS… (starting February 4, 2025, for China, and March 4, 2025, for Canada and Mexico, with worldwide tariffs effective April 2, 2025). • The court found that IEEPA does not grant the President authority to impose unlimited tariffs. The Worldwide and Retaliatory Tariffs exceeded IEEPA's scope by addressing trade deficits, which should be handled under specific trade laws like Section 122 of the Trade Act of 1974, not emergency powers. The Trafficking Tariffs failed because they did not directly "deal with" the stated emergency (drug trafficking) but were instead used as leverage, which IEEPA does not permit. The court emphasized that such broad tariff powers would violate constitutional separation of powers.What's Next? The tariffs are vacated and permanently enjoined, meaning they cannot be enforced. The Trump administration has already appealed the ruling. The appeal will likely go to the U.S. Court of Appeals for the Federal Circuit, where the decision could be upheld, overturned, or modified.
