HUGE development in Alien Enemies Act case that SCOTUS entered a stay for an entire class that had not been certified. District judge now denies class certification.
2 individual aliens sued to challenge removal under Alien Enemies Act & asked for the court to make it a class action so that every alien detained in the geographic area was automatically a plaintiff too. When court makes something a class action they "certify" a class.
The court refused to certify a class so it is not a class action. Thus any remedy, such as barring Trump from removing aliens under Alien Enemies Act only applies to the 2 named plaintiffs--not every alien in the area.
