I would be willing to bet they are calling it "disturbing the peace" which is a crime.

How in the heck did that cop ever qualify to become a Sergeant? He acted worse than a rookie cop on the first day of duty. WTF kind of "policing" was that? How was that considered "to serve and protect?" At the very least, that cop should lose his stripes, if not be relieved of duty altogether.
