Democrats say Trump doesn't have the authority to prosocute a war according to the Constitution only the Congress has the authority to declare war. THIS IS PATENTLY FALSE!!! The War Powers Act, more formally and correctly known as the War Powers Resolution (or War Powers Resolution of 1973), is a U.S. federal law (Public Law 93-148, codified at 50 U.S.C. §§ 1541–1548) passed by Congress to limit the President's ability to commit U.S. Armed Forces to armed conflict without congressional approval. consistent with the U.S. Constitution (which gives Congress the power to declare war under Article I, Section 8, while the President serves as Commander-in-Chief under Article II, Section 2). The main requirements include: • Consultation — The President must consult with Congress "in every possible instance" before introducing U.S. Armed Forces into hostilities or situations where imminent involvement in hostilities is clearly indicated. • Notification (the "48-hour rule") — In the absence of a congressional declaration of war or specific statutory authorization, the President must submit a written report to Congress (to the Speaker of the House and the President pro tempore of the Senate) within 48 hours of introducing U.S. forces into: • Hostilities, • Situations where imminent involvement in hostilities is clearly indicated, or • Circumstances involving deployment of combat-equipped forces (or substantial enlargements of such deployments). The report must include the circumstances, estimated scope and duration, and the constitutional/legal authority for the action. • Time limit (the "60-day clock") — Unless Congress declares war, passes a specific authorization for use of military force (AUMF), or extends the period, the President must terminate the use of forces within 60 days of the report (or the start of hostilities if no report is required). An additional 30-day withdrawal period is allowed if needed for safe removal, making a total of up to 90 days. IT HAS BEEN USED BY EVERY PRESIDENT SINCE NIXON!
