Rep. Eric Swalwell is ineligible to run for governor because he does not meet the state's constitutional residency requirement.
The lawsuit filed by Joel Gilbert alleges that Swalwell, widely viewed as a strong contender to succeed Gov. Gavin Newsom, actually resides in Washington, D.C., rather than California.
California’s constitution mandates that candidates for governor must have been residents of the state for the five years immediately preceding the election.
Gilbert's complaint points to public records, including a 2022 mortgage document for a Washington, D.C., property that Swalwell and his wife signed, designating it as their "principal residence."
The filing also notes that Swalwell listed no current or past ownership or leasehold interest in California property based on available records.
