Democrat Superior Court Judge Roy Wiggins signed an order transferring m*rder suspect Decarlos Brown Jr. from Mecklenburg County Jail to Central Regional Hospital in Butner for a 60-day mental health competency evaluation.
The judge wants to find out if Brown Jr. is fit to stand trial, but critics claim the judge is using a loophole to release a violent repeat offender back into the streets under the guise of treatment.
The evaluation was requested by his public defender citing a "long history" of schizophrenia - which could lead to an insanity defense or indefinite hold, shielding Brown Jr. from being held accountable in the train attack.

Zarutska's boyfriend slammed Wiggins as "unqualified," vowing Brown "will never see the light of day," while Republicans warn this exemplifies Democrat-driven leniency that endangers the public.
Brown faces the death penalty or life in prison for the transit killing, however the evaluation could stall state and federal trials indefinitely.

This order follows the decision of Magistrate Judge Teresa Stokes, who freed Brown on a "written promise" despite his 14-arrest history - just before Brown Jr. repeatedly stabbed Zarutska on the train.
North Carolina House Republicans, led by Speaker Tim Moore, have demanded Stokes' immediate removal, accusing her of "willful and persistent failure" to uphold her duties.
"By releasing a 14-time offender on nothing but his word, this judge put ideology over innocent lives," Moore stated in a formal letter to judicial oversight officials.
U.S. Transportation Secretary Sean Duffy blasted the incident as a failure of "pro-crime" policies, while President Donald Trump declared Zarutska's blood is "on Democrats' hands," highlighting how soft-on-crime policies put everyday Americans in danger.
