In this report, a state or local government qualifies as a sanctuary
jurisdiction if it obstructs the enforcement of federal immigration law.
Examples of obstruction include:
Prohibiting law enforcement officers or public employees from cooperating with federal immigration authorities;
Prohibiting law enforcement officers from honoring an ICE detainer or directing officers to ignore ICE detainers;
Prohibiting
law enforcement officers or other public officials from inquiring about
immigration status or sharing such information with federal officials;
Denying federal immigration officers access to jails, prisons, or courthouses;
Requiring a “judicial” or “court-ordered” warrant to comply with a detainer request;
Enacting
policies that prohibit the construction of immigration detention
centers or prohibit state or local jurisdictions from entering into
contracts with private detention facilities;
Restricting prosecutors or court officials from sharing information related to an alien’s court proceedings; and
Allowing aliens to plead to lesser charges or a lesser sentence to avoid immigration consequences.
