So exactly who chooses which laws are constitutional and which are in fact unconstitutional. We the People do. We do it by obeying those laws we feel are withing the strict restraints of the Constitution and disobeying or ignoring those laws we believe to be unconstitutional. If arrested and put on trial it is the responsibility of the government to prove beyond the shadow of a doubt that the law or laws a person is accused of violating are in fact stand up to the extreme scrutiny of the strict limitation of the Constitution including the Bill of Rights. If the government is unwilling or unable to prove beyond the shadow of a doubt that a law is constitutional all charges must be dropped immediately and the person released.Sad fact the average person DOES NOT know what is written and what is hearsay because they themselves have never taken the time to read the Constitution to learn for themselves what all it contains. Another sad fact for the vast majority of American citizens it is a lot easier to simply pay the fine and get it over with, than it is to stand up against most unconstitutional laws in a court of law. By not challenging those laws we are allowing the Government to impose tyrannical rule over us.
