There was no lawful precedence in British law for a colony to just decide to leave its mother country and go its own way. You had no legal right to take up arms against your King and Government. That was treason, no matter how morally justified you may have feel.
Now in 1860, secession of the southern states was not illegal. There was nothing written in law, the Constitution, etc., to prohibit such action. In fact, the Constitution clearly states, (paraphrasing) "that any power not specifically designated to the Federal Government, remains with the states." The Federal Government is not given anywhere in that document the right to prevent a state from leaving the union they joined freely. In fact, several states when agreeing to join the Union had specifically joined on the understanding they could leave the Union if they desired, one of which was Virginia.
In addition the Southern States did not rebel themselves out of the Union they voted themselves out of a Union, democratically, using the rights that they believed they had at the time. It is also worth remembering that the 13 original colonies were recognised in the treaty of Paris by the British as being Sovereign and independent, and the treaty lists each former colony by name.
So there is a difference between 1776 and 1860. It is not a moral difference, but strictly a legal one. One was treason and rebellion, the other an exercise in lawful action. What is ironic and comical is that a Nation/Government that went to war to fight for independence from a supposedly overbearing unjust King and Parliament, and claim it as a right of man to liberty and independence, then 80 years later seeks to prevent members of their own Country from doing the same, exercising their rights to be free and independent.
